What qualifies as “Active Efforts”?
Active Efforts means affirmative, active, thorough, and timely efforts to prevent the breakup of the Indian family. They go beyond mere reasonable efforts and must be documented throughout the case.
When is a QEW required?
A Qualified Expert Witness is required at foster care placement hearings and Termination of Parental Rights proceedings involving an Indian child under ICWA.
Who can serve as a Qualified Expert Witness?
Under 25 C.F.R. § 23.122, a QEW must have knowledge of the tribe's social and cultural standards. The BIA order of preference starts with tribal members recognized by the community.
